EU Packaging and Packaging Waste Regulation Article 24 caps void at ≤50% for grouped, transport, and e-commerce packaging from 1 January 2030 — or 36 months after methodology publication, whichever is later (realistically Feb 2031). Regulation (EU) 2025/40 takes effect on 11 February 2025. Article 24 establishes the void space rule — and explicitly defines filler materials (paper cuttings, air cushions, bubble wrap, sponge filler, foam wool, wood wool, polystyrene) as empty space, not product.
Core PPWR obligations take effect across all EU member states. Brands must begin adapting packaging design, procurement, and technical documentation.
Two things land on the same date: (a) sales packaging must already be reduced to "minimum necessary"; (b) European Commission deadline to publish the official empty-space calculation methodology. Formula: (Box Volume − Product Volume) ÷ Box Volume × 100.
The 50% cap applies from 1 January 2030 OR 36 months after methodology publication, whichever is later. If the Commission uses its full window to Feb 2028, real enforcement shifts to 12 February 2031. Fines up to €200K (NL/DE) or €100K (FR) per violation.
PPWR Article 68 delegates enforcement to member states with penalties that must be "effective, proportionate, and dissuasive" — designed to outweigh the economic benefit of non-compliance. Netherlands: avg €15K, up to €200K for repeat violations, plus €5K/week ongoing penalties. Germany: up to €200K per violation. France: up to €100K per violation. Plus product recalls, market withdrawal orders, customs holds, and marketplace delisting.
